Terms of Service

1. Acceptance of Terms

By accessing and using A11y Scanner ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

A11y Scanner is a web-based accessibility compliance scanning tool that analyzes web pages and HTML content for accessibility violations based on WCAG, Section 508, and ADA standards. The Service includes AI-powered fix suggestions and compliance reporting.

3. User Accounts

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years old to use the Service

4. Service Plans and Pricing

The Service is offered in three tiers:

• Free: Limited to 5 scans per month with advertisements displayed
• Pro ($19/month): Unlimited scans, AI fix suggestions, no advertisements
• Enterprise ($49/month): All Pro features plus priority support and team features

Prices are subject to change with 30 days' notice. Subscriptions are billed monthly through Stripe and can be cancelled at any time.

5. Acceptable Use

You agree not to:

• Use the Service to scan websites you do not own or have permission to test
• Attempt to overload, disrupt, or exploit the Service
• Use automated tools to access the Service beyond normal usage
• Circumvent any usage limits or access controls
• Use the Service for any illegal or unauthorized purpose
• Resell or redistribute the Service without authorization

6. Intellectual Property

The Service, including its design, features, and content, is owned by A11y Scanner and protected by intellectual property laws. Scan results and reports generated for your content belong to you.

7. AI-Generated Suggestions

The AI fix suggestions provided by the Service are generated using artificial intelligence and are intended as guidance only. While we strive for accuracy, we do not guarantee that AI suggestions will be correct, complete, or suitable for your specific use case. You are responsible for reviewing and testing any code changes before implementing them.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee that the Service will identify all accessibility issues, that scan results will be 100% accurate, or that implementing suggested fixes will ensure full compliance with any accessibility standard or law.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, A11Y SCANNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO ANY CLAIMS OF NON-COMPLIANCE WITH ACCESSIBILITY LAWS.

10. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the modified terms. Material changes will be communicated via email or prominent notice on the Service.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
